Terms and Conditions

Terms and conditions of sale

  1. The terms and conditions of sale apply to all orders for works and services concluded with Michael Dürnholz SRL, whose registered office is located at Aachener Straße 5, B-4700 Eupen, Belgium.
  2. Invoices are payable without deduction within 14 days of the invoice date at our registered office, in cash or by bank transfer.
  3. In the case of an order for bespoke jewellery, the jeweller is entitled to demand a substantial deposit and may suspend their obligations until the deposit has been paid in full.
  4. Delivery and right of withdrawal for online orders

For insurance and security reasons, jewellery delivery is carried out exclusively by the Mikkropakket Belgium delivery service.

You have the right to withdraw from this contract without giving any reason within a period of fourteen days.

The cancellation period expires 14 days after the day of delivery – confirmed by the delivery service Mikropakket Belgium or its subcontractors, or by you, or a third party other than the carrier and designated by you, who takes physical possession of the goods.

To exercise the right of withdrawal, you must notify us (michael.durnholz@md-jewels.eu) of your decision to withdraw from this contract by means of an unambiguous statement (e.g. a letter sent by post or email). You may use the model withdrawal form, but it is not obligatory. For the withdrawal deadline to be met, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

You must notify Michael Dürnholz Srl, Aachener Straße 5, 4700 Eupen, Belgium, so that the return of the goods can be arranged by them without undue delay and, in any event, no later than 14 days after you have communicated your decision to withdraw from this contract to us.

If you cancel this contract, we will reimburse all payments received from you, including delivery costs, without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to cancel this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Your liability is engaged only in respect of the depreciation of the property resulting from abnormal wear and tear or handling other than that necessary to establish the nature, characteristics and proper functioning of this property.

  1. Invoices not paid by the due date will be subject to interest at a rate of 12% per annum.
  2. It is agreed between the parties that, in the event of non-payment or late payment of the total amount of the invoice, the sum still due shall be increased by 15% of the outstanding balance, as compensation for the costs incurred as a result. This compensation shall be payable automatically and without the need for formal notice, solely on account of the delay in payment, in addition to the contractual interest.
  3. Until full payment is received, the jeweller remains the exclusive owner of the jewellery sold.
  4. All claims for patent defects must be made by registered letter at the latest 8 days after delivery.
  5. The stated lead times and delivery dates are purely approximate and non-binding. No compensation may be claimed for delayed delivery, and the contract may under no circumstances be terminated.
  6. In accordance with the provisions of the Belgian Civil Code, all goods sold to a consumer benefit from a two-year legal guarantee of conformity from the delivery of the goods. This guarantee covers any lack of conformity existing at the time of delivery. In the event of a lack of conformity, the consumer is entitled, free of charge, to the repair or replacement of the goods, within a reasonable time and without major inconvenience. If repair or replacement proves impossible or disproportionate, the consumer may request a price reduction or the cancellation of the contract (except in the case of a minor defect). The legal guarantee applies independently of any commercial guarantee that may be granted. The goldsmith is not responsible for shock resistance or the breakage of jewellery, stones or pearls.
  7. The courts of the judicial district of EUPEN shall have sole jurisdiction to hear all claims, disputes, execution and interpretation of the contract, for deliveries and services arising from the contract, regardless of whether the services and deliveries are carried out in Belgium or abroad
